Probate: What It Is & How To Avoid It
When you die, many of your assets will have to go through the court process known as probate before they can be shared with your beneficiaries unless you have created a personal, individual estate plan.
Probate is a time-consuming, costly, and open-to-the-public procedure in California like most court processes are. Avoiding probate is the major objective of most estate plans due to this fact.
The court is in charge of a number of different legal actions throughout probate, all of which are used to complete your affairs and settle your estate. Although we'll go into greater depth on some of them later, the following processes are typical in probate:
- Determining the validity of your will (if you have one);
- Appointing an executor or administrator to manage the probate process and settle your estate;
- Locating and valuing all your assets;
- Notifying & paying your creditors;
- Filing & Paying your taxes, and finally
- Distributing your assets to the appropriate beneficiaries.
In most situations, it's difficult for people you care about to go through all of this.
Why? Because it is pricey, takes time, is frequently highly inconvenient, and can even be messy at times.
You may assist your loved ones to avoid probate entirely or at the very least make the procedure as simple for them as possible by following these suggestions.
We'll go over how the probate process works and the many strategies you may use to avoid probate in the following article with a special focus on how to plan ahead.
